This is a translation provided for convenience. In case of discrepancy, the Italian version prevails.
1. Who we are
The EoriPronto service is provided by Pasqui Spedizioni Internazionali Srl, Via Btg. Val Leogra 168 – 36100 Vicenza (VI), P.IVA 01710930247, email pasquisped@gmail.com ("we", "us"). We are a private international freight forwarding and customs assistance agency. We are not the Agenzia delle Dogane e dei Monopoli (ADM, Italian Customs and Monopolies Agency) nor a public body, and we do not act on its behalf.
2. Definitions
- Customer: the person who requests the service through the website, for themselves or for the business or association they represent.
- Consumer: a customer who is a natural person acting for purposes outside their trade, business or profession (Italian Consumer Code (Legislative Decree 206/2005)).
- EORI application: the application for the assignment of the EORI number to be submitted to the territorially competent Customs Office.
3. The service
The service includes:
- a preliminary check as to whether an EORI number is already active;
- completion of the official ADM application form for the assignment of the EORI number using the data provided by the customer;
- a check of the completeness and consistency of the data and documents by an operator;
- identification of the competent Customs Office and submission of the application by certified email (PEC), in the name and on behalf of the customer, on the basis of the mandate signed by the customer;
- notification to the customer of the outcome received from the Customs Office.
The service only concerns the Italian EORI number (prefix IT) issued by the Italian Customs Agency; EoriPronto does not apply for EORI numbers in other EU Member States or in other countries (e.g. the United Kingdom).
The assignment of the EORI number falls within the exclusive competence of the Agenzia delle Dogane e dei Monopoli: we cannot guarantee that it will be issued, nor the timing. The same application may be submitted by the customer directly to ADM, free of charge; our price remunerates only the assistance activity described above.
4. How the contract is concluded
The contract is concluded when the customer, having completed the form, signed the mandate and reviewed the summary showing the final price, confirms the request and completes the payment. We send a confirmation email with the application number, which constitutes confirmation of the contract on a durable medium.
5. Price and payment
The price is the one shown in the summary before confirmation, in euro and inclusive of VAT; there are no additional charges. Payment is made in advance using the methods offered on the website. We issue a proper invoice. A price that is manifestly incorrect owing to an obvious clerical error is not binding on us: in that case we will notify you before proceeding and you may cancel at no cost. If you notice an unusual charge, please report it to us immediately.
6. Customer obligations
The customer warrants that the data provided is true, complete and up to date, that the uploaded documents are authentic, legible and valid, and that they are entitled to apply for the number for themselves or for the entity they represent. Delays or refusals by the Customs Office due to incorrect or incomplete data or documents provided by the customer are not attributable to us.
7. Performance and timing
We normally submit the application to the Customs Office within 1 working day of payment and receipt of all the necessary documents. If the documents are not legible or data is missing, we will contact you and the time limits will run from when they are supplied. The time taken to issue the number depends exclusively on the Customs Office and is indicative only.
8. Right of withdrawal (consumers only)
The consumer may withdraw from the contract within 14 days of its conclusion, without giving any reason, by sending an explicit statement to pasquisped@gmail.com, for example: "I hereby withdraw from the contract relating to application no. …".
When placing the request, the consumer expressly requests that the service begin immediately, before the withdrawal period expires. Consequently, pursuant to art. 59(1)(a) of the Italian Consumer Code, the right of withdrawal is lost once the service has been fully performed, that is, when the application has been submitted to the Customs Office. If withdrawal is received before submission, we refund the full amount within 14 days, using the same means of payment used.
9. Refunds in other cases
- If, after payment, we are unable to submit the application for a reason attributable to us, we refund the full amount.
- If the Customs Office requests corrections due to an error in our completion of the form, we handle them at no additional cost.
- If it emerges that the entity already had an active EORI number despite the preliminary check, and the application has not yet been submitted, we cancel the application and refund the amount.
10. Liability
We perform the service with the required professional diligence. We are not liable for the decisions and timing of ADM, nor for damage resulting from incorrect data or documents provided by the customer. For customers who are not consumers, our liability is limited to the amount paid for the application, save in cases of wilful misconduct or gross negligence.
11. Complaints
Any complaints should be sent to pasquisped@gmail.com stating the application number. We reply within 14 days.
12. Governing law and jurisdiction
The contract is governed by Italian law. For consumers, the competent court is that of the consumer's place of residence or domicile; for other customers, the court of Vicenza has exclusive jurisdiction. The United Nations Convention on Contracts for the International Sale of Goods (Vienna Convention) does not apply. The consumer may also have recourse to the alternative dispute resolution procedures provided for by the Italian Consumer Code.
13. Final provisions
These terms apply to all requests submitted through the website; the applicable version is the one published at the time the request is confirmed. Should any clause prove invalid, the remaining clauses remain in force and the invalid clause is replaced by the valid clause that comes closest to its purpose.
14. Privacy
The processing of personal data is described in the privacy notice.
